Overtime work is work which exceeds 45 hours a week. As mentioned above, the work which exceeds the maximum weekly working hours in the balancing period or compensatory work is not considered as overtime work. There are three types of overtime work:
(i). For example, if the establishment was destroyed by force majeure reasons such as earthquake, fire or flood, the employer may require overtime work until the establishment is ready for its normal operation and production. The worker’s approval for overtime work is not required. The duration of overtime work is limited. The overtime work is finalized when the establishment begins to function regularly.
(iii). Overtime work in emergency (force majeure) situations: In the case of a declaration of mobilization by the President, overtime work in emergency is required at establishments serving the needs of national defense (art. 43). The worker’s approval for overtime work is not required. During the overtime period, the workers work in their maximum capacities.
